PROMOTION RULES: "GHOSTBUSTERS: FROZEN EMPIRE MERCHANDISE SWEEPSTAKE"
Columbia Pictures Corporation, LTD. (the Promoter), whose registered office is at 12th Floor, Brunel Building, 2 Canalside Walk, London, W2 1DG, is the Promoter for this promotion (the Promotion) in relation to “Ghostbusters: Frozen Empire" (the Movie).
The basic information on the Promotion is contained in the following table (hereinafter, the Mechanics), which is supplemented by the provisions of the terms and conditions (the Terms) expressed below and which apply to the Promotion, (the Mechanics and Terms together comprising the “Promotion Rules”). By submitting an Entry (defined below), you are agreeing to be bound by these Promotion Rules.
1. PARTICIPATION PERIOD
- The Promotion will begin on 4th March 2024 from 00:00 (“Start Date”) and end on 24th March 2024 at 23:59 (“Closing Date”). The winner will have three days to respond to the email and claim their prize, after three days with no response the prize will be offered to another Entrant chosen at random.
2. TERRITORIAL SCOPE
- The Promotion is only open to residents in the Great Britain (excluding Northern Ireland).
3. PRIZE
The Competition prize consists of one prize (“Prize”) as follows:
One of ten Ghostbusters: Frozen Empire merchandise bundles, including a Mini Stay Puft Keychain, a Stay Puft Squishy and a Slimer Glow-In-The-Dark Slime.
4. HOW TO PARTICIPATE
All Competition entries must be received by the Promoter by the Closing Date (each an “Entry”). Each individual submitting an Entry may be referred to as an “Entrant”. All Competition Entries received after the Closing Date are automatically disqualified.
To enter this Competition online, visit https://www.sonypictures.co.uk/ghostbusters-competition-entry-form and follow the online instructions and submit your entry via the online form provided. You may be required to input your personal information (first and last name, email address, post code, daytime telephone number and month and year of birth) and click “Submit”. By successfully completing the foregoing and subject to the entry limitations detailed herein you will receive one Entry into the Prize Draw.
By successfully completing the foregoing and subject to the additional entry requirements detailed herein, you will receive an Entry in the Prize Draw.
FACEBOOK, TWITTER, AND INSTAGRAM is not a sponsor or promoter of this Promotion. Use of their name and trademarks are used for description only.
NO PURCHASE NECESSARY: No purchase necessary and there is no charge to register for use of the website.
You may only submit one Entry per person to this Competition.
Entries over the maximum number of Entries will be void and will not be entered into this Competition. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
All Entries must comply with the content restrictions set out in Annex 1 (“Content Restrictions”).
5. ELIGIBILITY
- The Competition is open to all residents within the Territorial Scope listed above aged 18 years or over. The Promoter’s employees and those employees of agents or suppliers of the Promoter that participate in, or are linked to the development and production of the Competition, as well as their direct family members, are not eligible to participate in the Competition.
- In the event that any of the persons excluded from participating in the Competition are the winner, such persons will lose their right to obtain the Prize.
- In entering the Competition, you confirm that you are eligible to do so and eligible to claim any Prize you may win.
6. WINNER SELECTION
Once the Participation Period has ended:
- The winners will be chosen by random draw on or before 1st April 2024 (“Draw Date”) from Entries correctly submitted in accordance with these Terms (each a “Winner”).
7. COMMUNICATION WITH THE WINNER
- The Promoter will contact the winner[s] by e-mail, using the details provided when entering the Competition.

If you are a Winner, you will have one month from the date you receive the notice from us that you are a Winner and to claim the Prize. Instructions how to claim your Prize will be included in your winner notification.

The Promoter will make reasonable efforts to contact the Winner. If a Winner cannot be contacted or is not available, or has not claimed their Prize within the time frame specified above, we reserve the right to offer the Prize to another randomly selected Entrant.

Winners of the Prize must contact Prize Provider with three preferred travel dates in three separate months no later than six weeks prior to desired departure date.

If Winner is unable to participate in any of the stated activities then Prize Provider will offer suitable alternatives of equal value, alternative activities will be determined by Prize Provider at its sole discretion. If Winner chooses to forfeit any activities then no alternatives will be provided. Activities have no cash value, and cash will not be substituted for any Activity or Prize. Prize must be redeemed in accordance with government guidelines and COVID-19 rules and restrictions in place at the time of travel, the arrangement and additional costs for any COVID-19 testing, quarantine accommodation or other expenses that may be incurred are the sole responsibility of the Winner and guest.
TERMS & CONDITIONS
1, DISQUALIFICATION
1.1 We will not accept entries to the Promotion which are (i) automatically generated by computer; (ii) where an Entrant attempts multiple Entries by using multiple/different Social Media accounts, email addresses, identities, registrations and/or logins, (iii) completed by third parties or in bulk; (iv) illegible, have been altered, reconstructed, forged or tampered with; (v) incomplete (vi) does not comply with these Promotion Rules.
1.2 Any Entrant who makes any abusive or fraudulent use of the application, support, computer program or website through which the Promotion is developed will be disqualified from participation in the Promotion. In the event that we detect any anomaly, or suspect that an Entrant is preventing the normal development of the Promotion, or illegally altering their registration and/or participation through any procedure, technical or computer, in order to distort their participation, we may unilaterally eliminate the registration of that Entrant.
1.3 We may also disqualify any Entrant whose actions we consider, in our sole discretion, in any way adversely impacts on the Promoter’s reputation, the Promotion or any other person or entity related to the Promoter and/or the Promotion. The same will be the case if we are made aware of any possible infringement of third-party rights and/or applicable legislation and regulations by an Entrant in connection with their participation in the Promotion.
1.4 We reserve all rights to disqualify Entrants whose conduct is contrary to the spirit or intention of the Promotion.
1.5 Failure of any Entry to comply with the above Entry requirements and the Content Restrictions attached hereto as Annex 1 and incorporated by reference, as determined by Promoter, in its sole discretion, may result in disqualification of Entrant. Entries must be suitable for presentation in a public forum, in sole determination of Promoter.
1.6 The disqualification of an Entrant for any reason will not affect the assignments of rights that, if any, would have been made in favour of the Promoter in accordance with the provisions of these Terms.
2. DURATION
2.1 The Promotion will be carried out during the Participation Period indicated in the Mechanics. However, we may at any time decide to discontinue and/or terminate the Promotion early where it becomes necessary to do so, including where the delivery of the Promotion is adversely impacted by reasons beyond our control.
3. THE PRIZE
3.1 The identity of the Prize and, where applicable, its total number are detailed in the Mechanics.
3.2 The instructions and conditions by which the winner can claim the Prize is detailed in the Mechanics.
3.3 The maximum claim period by which the winner must claim their Prize will be as indicated in the Mechanics. If you do not claim the Prize by this date, your claim will become invalid.
3.4 The Promoter will not be responsible for any failure or delay, temporary or permanent, in delivering the Prize, either by itself or by third parties, for reasons of beyond its control.
3.5 Prizes are subject to availability. The Promoter reserves the right to substitute the Prize with one of equal or greater value than the original in the event we are unable to provide the original Prize for reasons beyond our control. Prize may not be sold, bartered or exchanged by winner. Any unclaimed and/or unused Prize will remain the property of Promoter. The Prize is non-transferable, non-assignable and has no cash value. No substitutions of the Prize, including Prizes involving travel, by the winner are allowed. Prize is provided "as is" and without any warranty of any kind. By accepting the Prize, winner acknowledges compliance with these Promotion Rules.
3.6 The winner is responsible for all applicable taxes, fees, and expenses associated with Prize receipt and/or use. All tax liabilities are the responsibility of the winner.
4. WINNER ANNOUNCEMENT
4.1 The decision of the Promoter is final and no correspondence or discussion in connection with the award of the Prizes will be entered into.
4.2 In compliance with advertising regulation, we must either publish or make available information that indicates that a valid award took place. To comply with this obligation we will send the surname and county of prize winners and, if applicable copies of their winning entries, to anyone who writes to the Promoter at the address set out at the beginning of these Promotion Rules within one month after the Closing Date.
4.3 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter at the address set out at the beginning of these Promotion Rules. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
5. DISCLAIMER & LIMITATION OF LIABILITY
5.1 The Promoter is not responsible for possible failures of any software or connectivity that may affect the operation of the Promotion (e.g. inability to register any Entrant), nor from incidents that originate in cases beyond our reasonable control including a breakdown in the computer network, loss of connection or malfunction of the connection.
5.2 The Promoter is not responsible for errors in sending and/or receiving the email that constitutes the form of communication with the winner, whatever the cause of such errors.
5.3 To avoid any doubt, where the entry route for the Promotion is online, the Entrant’s participation in the Promotion shall be deemed to have taken place when the server or other means used by the Promoter and/or third parties for the management of the Promotion receives and effectively records the Entrant’s participation. Therefore, the receipt by the Entrant of an automated proof of submission (e.g. a thank you message or an automatic receipt of confirmation of participation) does not constitute sufficient proof of effective submission to the Promotion.
5.4 The Promoter informs Entrants that, given the characteristics of the internet (such as the free collection of distributed information and the difficulty or even inability to control the use that third parties may make of such information), it will not be at all responsible for the misuse of such information.
5.5 In relation to materials that may be submitted by Entrants in accordance with the Mechanics of the Promotion (such as data, photos, stories, videos, trademark replies, and in general any material, comments, posts, tweets, post or submit), the Promoter reserves the right not to post, delete and/or directly destroy any message, post, tweet, account, photograph, video or material of any kind that, in its sole discretion, constitutes or represents illegal conduct, thought or activity, contrary to the dignity, respect and rights of individuals, or whose dissemination may infringe the rights of third parties or, in general, understands that its subject matter is not appropriate to be disseminated. Correspondence will not be maintained about the inclusion, rejection or deletion of stories, messages, photographs, videos, materials, comments, posts, tweets or communications. The Promoter may remove the data, stories, messages, photographs, videos, images or communications included on a website, social networks and/or any other support for the Promotion after the period of time it deems appropriate.
5.6 To the extent permitted by law, the Promoter accepts no liability for any damage, loss or injury suffered due to entering this promotion or taking up a Prize. The Promoter is not responsible for any hidden defects or defects that may be presented by the said Prize and that are attributable to the manufacturer or distributor thereof, nor for damages arising from the own or improper use of such Prize.
5.7 In case of the Promoter’s inability to contact the winner(s) within the period indicated in the Mechanics, the Promoter reserves the right to declare the Promotion terminated.
5.8 The Promoter reserves the right to suspend, defer or cancel all or part of this Promotion, without such suspension, postponement or cancellation implying any liability for the Promoter, communicating it as soon as possible to Entrants who have already participated in it. The Promoter also reserves the right to modify these Terms, where necessary, in order to adapt to legislative, business and/or technological changes.
5.9 Each Entrant expressly acknowledges and agrees that, in the event of non-compliance or alleged breach by the Promoter of any obligation expressed in these Terms, the Entrant shall in no way have the ability to seek equitable measures or justify the imposition of the cessation or otherwise restrain the development, production, advertising, distribution, promotion, or exploitation of this Promotion and/or the Movie and/or any other audio-visual work, production or project of Promoter or any of its affiliates.
5.10 In accordance with the provisions of the rules for promotions in force on FACEBOOK, INSTAGRAM and TWITTER and any other social networks used in connection with the Promotion, we inform Entrants that this Promotion is not sponsored, endorsed, managed or associated in any way with such platforms. Therefore, the Entrant in accepting these Promotion Terms is fully aware that they are providing their information to THE PROMOTER and not to FACEBOOK, INSTAGRAM, TWITTER or the applicable social network. However, the Promoter is not responsible for the processing of personal data that Entrants have provided directly to FACEBOOK, INSTAGRAM, TWITTER, or any other social network used in connection with the Promotion, over which the Promoter does not exercise any control. The Promoter recommends that Entrants carefully read the Privacy Policy of such social network. Likewise, the Promoter assumes no responsibility for any errors or failures in the operation of such social networks that may interfere with the Entrant’s participation in the Promotion.
5.11 The Entrant undertakes to comply with and respect the policies and terms and conditions of use of any such social networks used in connection with the Promotion. ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF APPLICABLE CRIMINAL AND/OR CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
5.12 Entrant agrees to release, defend, indemnify and hold harmless each of Promotion Parties, and each of their owners, employees, directors, officers, shareholders, members, agents, subcontractors and licensees from all claims, demands and causes of action of any nature whatsoever which Entrant heirs, representatives, executors, administrators, or any other persons acting on Entrant’s behalf or on behalf of Entrant’s estate, have or may have by reason of: (i) Promoter’s exercise of any rights granted by Entrant herein; or (ii) claims based on violation of any right of publicity or rights of personality, infringement of copyright or trademark, libel, slander, defamation, invasion of privacy, loss of earnings or potential earnings in connection with Entrant’s use of the entry and any portion thereof, or the likeness of any natural person therein.
6. OWNERSHIP OF ENTRIES & INTELLECTUAL PROPERTY RIGHTS
6.1 To the extent the Entrant must ‘create’ an item (such as photo, video, or drawing) each Entry must be an original creation of the submitting Entrant, which is under no restriction, contractual or otherwise, that will prevent Promoter’s use of the Entry and each Entry must be free of any and all liens, encumbrances and claims of third parties. Entrant acknowledges, agrees and warrants that, nothing in the Entry infringes on any copyrights, confidential information, trade secrets or trademarks belonging to any person or entity other than the Entrant absent a suitable license, clearance or permission agreement (proof of which is required upon submission), or violates any person's rights of privacy or publicity and that all necessary releases and permissions have been secured. Entrant agrees to indemnify and hold harmless each of Promoter and Supplier, and each of their owners, officers, directors, employees, and affiliated organizations, and their respective officers, directors, shareholders, employees, and advertising and promotion agencies (collectively the “Promotion Parties”), from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by Entrant of these Promotion Rules or the warranties and representations made by Entrant in this paragraph. Modifying, enhancing or altering a third party’s pre-existing work does not qualify as Entrant’s original creation. All Entries will be subject to the Content Restrictions.
6.2 All Entries to the Promotion and any accompanying material submitted to the Promoter in connection with the Promotion will become the property of the Promoter on receipt and will not be returned.
6.3. By submitting your Entry and any accompanying material, you agree to:
- 6.3.1 Assign to the Promoter all your intellectual property rights with full title guarantee; and
- 6.3.2 waive all moral rights;
in and to your Entry and otherwise arising in connection with your Entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world. In addition, Entrant acknowledges and agrees that Promoter may use any ideas from any Entry or other submitted materials, whether or not Entrant has been awarded a prize in connection with any such Entry or other materials.
7. PROTECTION OF PERSONAL DATA
7.1 The Promoter will only process your personal data as set out in the Privacy Policy located at https://www.sonypictures.co.uk/privacypolicy. To the extent the Promotion is conducted on a social media platform, any personal information you provide via that platform maybe be subject to the platform’s privacy policy.
8. GENERAL
8.1. If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Promotion.
8.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Promotion where it becomes necessary to do so.
8.3 In the event that any provision or provisions of these terms and conditions are held to be void or unexplained, in whole or in part, by any court, court or competent administrative body, the remaining provisions will remain in full force and effect.
8.4 The non-exercise or enforcement by the Promoter of any right or provision contained in these conditions shall not constitute a waiver thereof.
9. APPLICABALE LAW AND JURISDICTION
9.1 These terms and conditions (and any non-contractual disputes/claims which arise out of or in connection with them) will be governed by English law and entrants submit to the non-exclusive jurisdiction of the English courts.
